The Digital Personal Data Protection Act (DPDPA), 2023 marks a significant milestone in India’s journey toward safeguarding digital privacy and responsible data governance. This landmark legislation establishes a comprehensive framework for the processing of personal digital data, ensuring that data fiduciaries—entities handling such data—operate with accountability, transparency, and in alignment with well-defined obligations. At the same time, it empowers data principals—the individuals to whom the data pertains—with enforceable rights and defined responsibilities, while also laying down strict penalties for violations.
In 2025, the Ministry of Electronics and Information Technology (MeitY) released the draft Digital Personal Data Protection Rules, which provide the operational contours for implementing the Act. These rules elaborate on crucial aspects such as the mandatory notice that data fiduciaries must issue to individuals, the registration and responsibilities of consent managers, and the processing of personal data for public services such as subsidies and benefits. They also cover the enforcement of reasonable security safeguards, protocols for breach notifications, mechanisms for individuals to exercise their rights, provisions for processing data of children and persons with disabilities, and the institutional framework for data protection.
The rules detail the establishment of the Data Protection Board of India, including the appointment, service conditions, and functioning of its Chairperson and members, with a digital-first approach to its operations. They further outline the procedures for appeals to the Appellate Tribunal, cementing a strong grievance redressal framework.
